In common sense the law of tort is a breach of law controlling behavior of the people in society. It is growing breach of law and it's main aim is to define individuals rights.and duties in light of prevalent standards of reasonable conduct and public convenience. It provide remedy for violation done against the private rights of an individual. The principle aim of law of tort is to provide compensation to victims or their dependents. The breach of law has attained great importance in England and other western countries, through not to extent in India. The term 'tort' is the french equivalent of the English word 'wrong' and Roman term 'delict'. Tort is derived from the Latin 'tortum' means 'twisted' or a 'crooked' act ,a deviation from straight or right conduct. In this generic sense it was introduced into the terminology of the English law by the French-speaking lawyer and judges of the court of Nomandy and Angevin kings of England. But it was an obscure term till the middle of the seventeenth century.
There were certain recognized forms of action for providing remedy for wrongful conduct. An action was commenced through royal write. These were issued from special departments of Government known as officina brevium.
The Writes which reminded the injuries now known as tort were at first the 'writ of tresspass' and later, after some extension, the writ of 'trespass of case's. The writ of trespass lay for direct and immediate injuries to land, good or person. It did not extend to indirect or consequential injuries. Remedy for these indirect or consequential injuries lay on the case
