CONTRIBUTION BETWEEN JOINT TORT FEASORS

Rules of Merriweather v.Nixan:
In Merriweather v.Nixan M ana N jointly destroyed the machinery of one S,who brought an action against both and obtained a judgment for £840 he levied for recovery wholly on M,M brought an action against N for a contribution on the mejority. It was held that M could not recover. The ratio of this case is known as the rule in Merriweather v.Nixan, which means that defendants could neither get an immediate for the whole of what he paid nor a contribution of a part of it. It other words, there is no contribution between joint tort feasors.
The correctness of the decision in Merryweather v.Nixan, has been seriously doubted since the very date of it's judgment, and number of later cases have tried to modify or alter it's rigidity. The reason on the rules was that a wrong doer must himself bear consequences of committing a tort, and cannot enforce an agreement, Express or implied to share the loss or profit of an unlawful undertaking or to be indemnified against it's consequences. But these rules were significantly limited to manishif illegal act or willful wrong doing, and not to wrongful act done by ignorance or by negligence. This types of cases are generally found in the process of following or according to following theories:
CONTRIBUTION BETWEEN JOINT TORT FEASORS:
According to the rules obtained in English common law joint tort feasors could not seek contributions inter se and a tort feasors who was forced to pay the whole or more than a proportionate share of his damages, and had no claim against the other tort feasors for their share. The damages cannot be apportioned so as to award one sum against one defendant and another against the other defendants, through they may have been guilty of unusual degree. This principle was founded upon the well known maxim 'ex-turpi causa non oritur actio' No action arises from a bad act,but of a turpitude no cause of action arises. Joint tort feasors are jointly and severely. If sued jointly, the damages may be recovered from all or either. Each is responsible for the injury sustained by his common act.
