What is act of God ?

The defendant constructed three artificial lakes which were fed by a natural stream. The lakes were well constructed and adequate in all the normal circumstances. However, they were destroyed by a heavy rain fall if quiet exceptional violence, with the result that the plaintiff's brigade were damaged. It was held that the defendants was not negligent was not negligent and the accident was due to an act of God .
Act of God maybe defined as circumstances which no humans foresight can provide against any of the prudence is not bound to recognize the possibility, and which when they do occur, therefore, are calamities that result from them. Act of god includes those consequences which occasionally occur by elementary force of the nature unconnected with the agency of man. Common examples of the act of God are falling of tree,a flash of lightning ,a tornado or a flood. Here it is important to note that every loss caused due to rainfall or tree are not the example of act of God.

The essential condition of this defense are:-

1) the event causing damage was the result of natural forces without any intervention from human agency, and

2)the event was such that the possibility of an event could not be recognized by using reasonable care and foresight

Where a particular event amount to an act of God is qustion of fact. Today the scope of this defences is very limited because with the increase in knowledge the foresight also increases and it is expected that the possibility of the could have been visualized.

Whether a particular circumstances or occurence amount to an act of God is a question of fact in each case and the criterion for deciding it is "no human foresight and prudence could reasonably recognize the possibility of such an event. There is a tendency on the part of courts to limit the application of the defences of the act of God not because of the fact that it's applications in the case of absolute libality is diminished but because advancement in the scientific knowledge which limits the unpredictable.
